So my understanding of the non-tendering rule is it only applies for 'arbitration eligible' players (re: if you've hit 130 AB/50 IP and pass rookie levels). Which means you can't non-tender players before they hit those marks. However, you also can't send them back to unpaid minor leagues once you add them to the 40-man, you have to put them through waivers and risk losing them or leave them in paid minors. If I've misinterpreted either let me know, but as far as I can see this could eventually create situations where former top prospects flame out and are making $600k in paid minors forever because they never hit the rookie limits to be non-tendered.
I think either players should be allowed to be demoted and promoted off the 40-man freely without waivers or penalty till they hit rookie limits (ergo their salary comes off the books), or non-tendering should apply any season after players get put on the 40-man. Spitballing a little but perhaps the former - promote and demote freely without roster or salary consequences - should apply before they're rule V eligible and the latter after.

I think you should be able to non-tender a player on the 40 man roster who is not yet arbitration eligible (20xx)......(if your not already able to do so)

Yep my intention all along was that players who have not yet reached 130 AB / 50 IP can still be non-tendered. I'll make this language more explicit in the Constitution, such that non-tender candidates are all those arbitration eligible and players promoted from the 60 man minor league roster who have not yet exceeded rookie thresholds.
